What is an Adjustment of Status?

Adjustment of status is the process by which an individual applies to change their immigration status in the United States. This is a legal modification that shifts a visa holder to green card possession or allows a current green card holder to become an official citizen of the United States. At Musa Obregon & Associates, our legal practice covers two different areas of law. We are an immigration law firm as well as a criminal defense firm. We are dedicated to providing legal assistance to those throughout the world who desire to become residents of the U.S. Through a case evaluation, our firm can assess whether or not you are eligible to adjust your status to a more permanent standing.

Adjustment of Status Process

If you desire to change your residency status, it is important not to settle for the title you already possess. If you are denied, our firm can help you appeal the result. There is a specific process that you must go through in order to upgrade your residency status. The process is as follows:

  • Determine which category best fits your situation - family based, employment based, special class, or humanitarian programs.
  • File an immigrant petition, which depending on the category, may be filed at the same time as the adjustment of status application.
  • File Form I-485, which is an Application to Register Permanent residency, which will be filed with the United States Citizenship and Immigration Service (USCIS).
  • Get fingerprinted at your Application Support Center and attend an interview at the USCIS.
  • Receive your final decision in the mail and if necessary, appeal the result. You will then make the necessary changes.

Our experienced law firm can help you through each of the steps. We have more than 50 years of experience handling such situations and we can offer assistance as you put together the application. We will make sure that all necessary pieces are attached. Contact a lawyer from our firm today so that we can walk you through the process.
